Bloomfield Yachting

Terms

Last updated 13 September 2026

Three short sets of terms: for using this website, for sending us an enquiry, and for membership. Bloomfield Yachting is the trading name of Ross Bloomfield, a sole trader. "We", "us" and "our" mean Bloomfield Yachting. These terms are governed by the law of Antigua and Barbuda.

1. Using this website

You may browse the public pages freely. The members' app is for invited members only and you must not attempt to access it, or any other person's account, without authority. Everything on the site, including text, photographs and the software behind the app, belongs to us or our licensors and may not be copied for commercial use without permission. We work hard to keep the site accurate and available but it is provided as is; we are not liable for loss arising from your reliance on general information on the public pages, or from the site being unavailable.

2. Sending us an enquiry

Submitting the boat care enquiry or the charter enquiry places no obligation on you and none on us. It simply lets us understand what you are looking for and start a conversation. We do not sell your details and we will not chase you. How we handle what you send is set out in our privacy notice.

Charter enquiries: we act as an intermediary broker. We do not own or operate charter yachts. Any charter is contracted directly between you and the yacht's owner or operator on their terms, and any deposit or payment is made under that contract, not to us, unless we tell you otherwise in writing.

3. Membership

Membership is currently by invitation only, following a meeting, and no payment is taken through this website. The terms below describe how membership works so you can read them before you decide. The specific services, visit frequency and price for your boat are agreed with you in writing before anything starts.

What we do

We look after your boat in the way agreed with you: regular checks, cleaning, preparation before you use the vessel, keeping its safety and document register up to date, arranging and coordinating contractors, and the other services in your agreement. We keep a record of every visit, with photographs, which you can see in the app.

What we are not

We are not a marine surveyor, a naval architect, an insurer or a qualified engineer unless we say so in writing for a particular job. The register in the app records expiry dates you or we have entered; it is a reminder tool and does not replace your legal responsibility as owner to keep the vessel's safety equipment, certificates and insurance in date. Where a job needs a qualified contractor we will arrange one, and that contractor is responsible for their own work.

Moving and handling your boat

If we move your vessel, whether under its own power, on a mooring or by arranging a lift, we do so with reasonable care and skill and only when you have confirmed that your insurance covers the vessel being handled by us. You remain responsible for insuring your boat. We are not liable for loss or damage arising from a defect in the vessel or its equipment that we could not reasonably have known about, from weather, or from the acts of third parties, except where the law does not allow us to exclude it.

Access

You give us permission to board your boat and, where agreed, to hold keys and codes. We keep them securely and use them only for the agreed work.

Paying us

Fees, what they include and when they are due are set out in your written agreement. Prices are quoted in US dollars and exclude sales tax (ABST) unless we say otherwise; if our tax position changes we will tell you in advance. Contractor costs and parts are passed on at cost unless agreed otherwise.

Changing your mind and ending membership

If you are a consumer and you agreed to membership at a distance (by phone, email or online rather than in person), you have 14 days from the day you agreed to cancel without giving a reason. If you ask us to start work during those 14 days and then cancel, you pay for the work done up to that point. After that, either of us can end membership by giving the notice period in your agreement. We will hand back keys and anything of yours we hold, and you can ask for your records at any time.

Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Otherwise, our total liability to you in any 12 month period is limited to the fees you have paid us in that period. We hold public liability insurance and will show you the certificate on request.

Your information

How we handle your personal information, your boat's details and photographs is set out in our privacy notice. Photographs of your boat are used only to record work for you and are not published without your permission.

4. Problems

If something goes wrong, tell us and we will put it right. Email enquiries@bloomfield-yachting.com. Nothing in these terms affects your statutory rights as a consumer, including your right to services performed with reasonable care and skill.
